Our Research

  • This License Agreement is made and entered as of {{Date}} by and between Vote Mama Foundation Inc., a New York nonprofit corporation operating under Section 501(c)(3) of the Internal Revenue Code, and {{Licensee}} (“Licensee”).  In consideration of the mutual covenants set forth in this Agreement, the parties agree as follows:

    License of Politics of Parenthood Research

    Vote Mama Foundation Inc. has created the Politics of Parenthood Research, data sets that track the representation of parents serving as legislators in state and federal political office (“POP Research”). POP Research includes the following data sets: POP 2022, POP 2023, and CFCC 2021.

    • Vote Mama Foundation Inc. owns all POP Research, including underlying data and research findings.

    • Vote Mama Foundation Inc. grants Licensee a non-exclusive, non-transferrable, royalty-free, revocable license to use POP Research and display, copy, disseminate, and broadcast POP Research for Licensee’s educational use exclusively as set forth in this Agreement, during the term of this Agreement.

    • POP Research is provided “as is” without any warranty of any kind, either express or implied, arising by law or otherwise, including but not limited to warranties of completeness, non-infringement, accuracy, merchantability, or fitness for a particular purpose.

    • All such use must include an acknowledgment that POP Research was obtained from Vote Mama Foundation Inc. in a reasonably conspicuous manner.  On any printed material, or for use on any website page, the attribution statement must read: “Politics of Parenthood research provided by Vote Mama Foundation Inc.” Any social media use (including on Twitter and Instagram) must tag Vote Mama Foundation Inc.’s account handle @VoteMamaFdn.

    • Following the expiration of this Agreement, or sooner if the license herein terminates, Licensee shall cease all further use of POP Research and shall remove POP Research from any social media posts or other websites to which it had been published.

    POP Research will be provided without a license fee.

    Indemnification

    Licensee hereby agrees to indemnify and hold Vote Mama Foundation Inc. harmless from and against any losses, damages, fines, costs, or penalties (including reasonable attorneys’ fees) incurred by Vote Mama Foundation Inc. as a result of any claim, suit, proceeding or investigation, based upon or arising out of, the content of any action or communication by Licensee related to POP Research or other use thereof by Licensee.

    Licensee may use and disseminate POP Research only for 501(c)(3) non-partisan educational activities. Licensee may only use and disseminate POP Research for research or statistical purposes, and not for contacting or investigating specific research subjects. Any intentional identification of de-identified research subjects (including family members or dependents) or distribution of POP Research that purposely identifies minor children, or publishes research subjects’ private information which was not previously publicly available, is strictly prohibited.

    The term of this Agreement shall begin at the date of signing and continue in perpetuity. Vote Mama Foundation Inc. may revoke this license at any time, for any reason or no reason, upon 5 (five) days written notice to Licensee.  In the event that Licensee breaches or threatens to breach any term herein, Vote Mama Foundation Inc. may revoke this license effective immediately.

    Neither party may assign its rights or delegate its obligations under this Agreement without the express prior written consent of the other party.  This Agreement will be governed by and construed in accordance with the laws of the District of Columbia.  This Agreement constitutes the entire agreement of the parties relating to the subject matter of the Agreement; supersedes all prior agreements, oral or written; and cannot be modified except by a writing signed by both parties. In the event of an actual or threatened breach hereof, the Parties agree that Vote Mama Foundation Inc. may sustain damages that are difficult to quantify and that, in addition to any and all other legal or equitable remedies available to it, Vote Mama Foundation Inc. may seek an injunction or other equitable relief without the need to post bond or surety.
